1. Introduction

Flashy (“the App”) is an AI-powered flashcard generator developed by Matías Sandoval (“we”, “us”, “our”). This document explains how we handle data (Privacy Policy) and the terms that govern your use of the AI service (Terms of Use).

2. Privacy Policy

2.1 Overview

We respect your privacy. Flashy does not require you to create an account and does not collect personally identifiable information. All payments are processed securely through Apple’s In-App Purchase system.

2.2 Data We Do Not Collect

• No personal names, emails, or contact information
• No GPS or precise location data
• No tracking for advertising purposes
• No third-party analytics

2.3 Data We Process

To operate properly, we process limited technical and transactional data:

• Apple receipts – to verify subscriptions
• Prompts & AI responses – temporarily processed via OpenAI API to generate flashcards
• Usage counts – number of flashcards generated, stored in Firebase

2.4 How We Use Data

• To validate subscriptions and restore purchases
• To deliver AI-generated flashcards
• To ensure service stability and prevent abuse

2.5 Data Retention

Data is retained only as long as necessary: Apple receipts are kept per tax requirements; prompts are transient and not stored long term. OpenAI may retain data for up to 30 days for abuse monitoring, per its privacy policy.

2.6 Security

All connections are encrypted via HTTPS/TLS. The OpenAI API key is securely stored on our Firebase backend and never exposed to users.

2.7 Third-Party Providers

• Apple — payments & subscriptions
• Firebase (Google) — backend hosting
• OpenAI — AI text generation
• RevenueCat — subscription management and purchase validation

2.8 Children’s Privacy

Flashy is not directed to children under 13 and does not knowingly collect data from minors.

3. AI Terms of Use

3.1 License

You are granted a limited, non-exclusive, non-transferable, revocable license to use Flashy for personal, educational purposes in accordance with these Terms.

3.2 Fair Use

Each subscription tier (1000, 2000, 5000 flashcards per month) defines reasonable usage. Excessive or automated use beyond normal study activity may result in suspension.

3.3 Prohibited Activities

• Violating any applicable law
• Generating harmful, hateful, sexual, or discriminatory content
• Infringing intellectual property rights
• Attempting to reverse-engineer, hack, or exploit the API

3.4 AI Content Disclaimer

Flashy uses OpenAI’s GPT models to generate text. Accuracy is not guaranteed. You are responsible for reviewing generated content before relying on it for study or other purposes.

3.5 Payments and Subscriptions

• Subscriptions are handled exclusively by Apple via In-App Purchase.
• We do not access or store your payment information.
• Subscriptions renew automatically unless canceled 24 hours before renewal.
• Refunds or billing issues must be managed through Apple.

3.6 Termination

We may terminate or suspend access without notice if you violate these Terms or misuse the Service.

3.7 Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

3.8 Limitation of Liability

To the fullest extent permitted by law, Matías Sandoval shall not be liable for any damages arising from your use of Flashy or any AI-generated content.

3.9 Indemnification

You agree to indemnify and hold harmless Matías Sandoval from any claims, damages, or expenses arising from your use of Flashy or violation of these Terms.

3.10 Modifications

We reserve the right to modify these Terms or the Privacy Policy at any time. Your continued use of Flashy after updates constitutes acceptance.
